Original Petition & Military Affidavit
Most Counties in Texas are broken down into Precincts. You must file your Petition and Military Affidavit at the Justice of the Peace Court in the Precinct where your rental property is located. You can figure out your precinct by going to the Justice of the Peace websites below.
Every Justice of the Peace Court has an Original Petition and Military Affidavit available in their lobby, but you are almost always welcome to use your own as long as it complies with Texas law. Many of the Counties below contain the Original Petitions that are handed out in the lobbies of their Justice of the Peace Courts. Other Counties contain the Universal Original Petition & Military Affidavit that may be filed in any County**. The Justice of the Peace websites are provided below as a resource.

* Some Judges may prefer you use a Notice to Vacate that they have approved.
